Lauren Totushek has been practicing law since 2009. She received her Juris Doctorate from William Mitchell of Law in St. Paul, MN and her Bachelor’s Degree from St. Olaf College in Northfield, MN.

Lauren got her start in family law before law school.  Her experience with family law goes back to 2001 when she worked for Dakota County as a Child Support Specialist, enforcing child support orders. It was her passion for family law that convinced her to go to law school.

After graduating law school, Lauren worked for a firm doing solely bankruptcies. Since then, she has filed over 1,000 bankruptcies and thoroughly enjoys practicing bankruptcy law and protecting consumers from aggressive creditors and often illegal collection methods.

Lauren has the unique experience helping clients that are going through two life experiences that overlap: divorce and debt. She has counseled numerous clients on how to go through one or both of these without upsetting the other, and vice versa.

Lauren has been a speaker at the MFSRC (Minnesota Family Support and Recovery Conference) as well as the MCAA (Minnesota County Attorney Association) on the subject of the overlap of family law and bankruptcy; specifically, what sort of effect does a bankruptcy have on the collection of child support. Lauren has also given a seminar for financial advisors on what they should know about bankruptcy.

Outside of her law practice, Lauren enjoys spending time with her husband and two children, reading, and Netflix.

The most common types of actions in Family Law are divorce, custody, child support, and parenting time. Minnesota is a no-fault state, which means anyone can get a divorce, they don’t need to have a good reason or wait for the other spouse’s approval. The Minnesota court system has developed a very streamlined process that is intended to keep both parties focused on resolving all of the issues outside of court, so that most divorce cases are not decided by a judge.  However, this streamlined process can involve deadlines, required filings, and court appearances. Lauren can help you navigate through the process, taking part of the burden from you during this often tumultuous time.

The US Bankruptcy Code is designed for honest people who qualify for debt relief under federal law. Some people can feel guilty or ashamed about looking into filing Bankruptcy, but it is not designed as a way to cheat your way out of debt.

Lauren has extensive experience in filing bankruptcies: Chapter 7, Chapter 13, individual, or small business. She offers a free consultation, which is where she will be able to advise you whether you qualify for a bankruptcy and, most importantly, whether it would make sense for you to file. Many times bankruptcy is the most effective solution, but there may be other ways out of debt. You can expect Lauren to offer ideas on alternative ways to debt relief if bankruptcy is not the best option for you.
